Reversing a criminal conviction and restoring gun rights are two separate processes handled in different courts. However, the qualifications for both processes are very similar so we can handle both issues for you if you want. CLEARING A CRIMINAL RECORD: After your criminal charge(s) are vacated you can pass a criminal background check and legally say that you have never been convicted of a crime. Misdemeanors (excluding DUI) can be vacated (reversed & dismissed) after 3 years (5 years for domestic violence) if you haven't had any disqualifying issues with the courts. Class C felonies can be vacated (reversed & dismissed) after 5 years if you haven't had any disqualifying issues with the courts and the charge was not a sex offense. Class B felonies can be vacated (reversed & dismissed) after 10 years if you haven't had any disqualifying issues with the courts and the charge was not a sex offense. RESTORING GUN RIGHTS: After your Second Amendment rights are restored you would be eligible to apply for a CPL (concealed pistol license). Misdemeanors - 3 years must have passed without any disqualifying issues with the courts. Class C felonies - 5 years must have passed without any disqualifying issues with the courts. Class B felonies - 10 years must have passed without any disqualifying issues with the courts.
